Limited Role Disclosure, Conflict Waiver & Communication Acknowledgment

Oklahoma Divorce Cases

Your Smart Divorce is a platform associated with and operated in connection with The Smith Firm, PLLC. The Smith Firm provides limited legal services through this platform as described below.

Both spouses must accept this separately. Progress is disabled until both accept.

Spouse 1 Acceptance

The Smith Firm is assisting with the preparation of divorce documents using information entered by you and your spouse through Your Smart Divorce. The Firm’s role is limited to drafting and formatting documents based solely on the information you provide. The Firm does not represent you individually.

You understand that divorce involves spouses with opposing interests and that a law firm would normally not assist both parties. You agree that The Smith Firm is acting only as a neutral document preparer and not as an advocate for either spouse.

The Smith Firm will not give legal advice, recommend terms, negotiate between you, decide what is fair, or represent you in court. If a disagreement arises, The Smith Firm must stop providing services to both spouses.

You acknowledge that no confidential or privileged information has been provided to The Smith Firm on your behalf individually. Communications made through Your Smart Divorce are part of a joint effort to resolve issues and are intended as settlement-related communications. You agree that such communications are not confidential as between the spouses and are not intended to be admissible in court, except as permitted by Oklahoma law.

You understand that you have the right to hire your own attorney for independent legal advice and that you have either done so or chosen not to do so.

If the joint effort to resolve your divorce through Your Smart Divorce is not successful, you agree that The Smith Firm may represent either spouse in the future and you waive any conflict of interest arising from the Firm’s prior limited involvement in this joint document-preparation process.

By clicking “I Agree,” you knowingly and voluntarily waive any conflict of interest related to The Smith Firm’s role and accept responsibility for the accuracy of the information you provide.

This applies only to Oklahoma divorce cases and is governed by Oklahoma law.
